After the retrial… the head of the retirement council in Iraq was sentenced to imprisonment and a fine

Iraq’s Integrity Commission has revealed details of the sentences handed down against the former head of the pension commission and the director of the global smart company card “Ki Card” after the Court of Cassation accepted their retrial request.

The Authority’s Investigation Department indicated that the Central Anti-Corruption Criminal Court has issued a ruling in presence of imprisonment (one year and 9 months) against the two convicted, after they were retried on the charge of the first convicted taking a bribe from the second convicted, in exchange of business facilitation of the company “Ki Card” with the pension institution. And indicated that the decision of the sentence, issued in compliance with the provisions of the resolution (160 of 1983), included the imposition of a fine of (10,000,000) million dinars on each of them.

The circuit added that the Court of Cassation accepted the convicts’ request for a new trial after ascertaining the existence of the legal requirements. Because it is based on one of the grounds provided by theart. (270) cpp, for the emergence of facts and for the production of documents on which the trial judge did not carry out his own investigations. He indicated that the request for a retrial was accepted and the file was transferred to the court, to carry out the trial again, based on the provisions of articles (270/4, 271 and 275) of the code of criminal procedure.
