Elon Musk Settles Class-Action Lawsuits Over 2024 Voter Giveaways

Elon Musk and his political action committee, America PAC, have reached a settlement to resolve two class-action lawsuits stemming from the $1 million daily giveaways conducted during the 2024 election cycle. Settlement notices were filed on October 15, 2026, in the U.S. District Court for the Western District of Texas in Austin.

The legal resolution addresses claims brought by Arizona residents Jacqueline McAferty and Joy Harvick. The plaintiffs alleged that the sweepstakes, which Musk initially described at public rallies as a “random” drawing for registered voters who signed a petition, were deceptive. The terms of the settlement were not publicly disclosed in the filing and remain subject to final approval by U.S. District Judge Robert Pittman.

The “Random” Designation at Issue

The core of the legal dispute hinged on how recipients of the $1 million prizes were selected. While the program was marketed as a lottery-style drawing of chance, Musk’s attorneys provided a different account during 2024 court proceedings. Legal counsel admitted that the recipients were not chosen by random luck but were instead vetted and selected as “contracted spokespeople” for the PAC.

This admission contradicted Musk’s early promotional statements and formed the basis for fraud and breach of contract claims. According to reported claims, participants believed they had a fair chance at a random drawing, whereas the defense later argued that the winners were chosen based on their personal stories and suitability to represent the PAC’s values.

Broadening Legal Scrutiny

The 2024 program faced immediate pushback from election officials and law enforcement. Philadelphia District Attorney Larry Krasner filed a lawsuit during the 2024 presidential race, seeking to halt the sweepstakes as an illegal lottery. While a judge allowed the program to continue until the election concluded, the subsequent class-action suits in Texas focused on the transparency of the selection process itself.

Despite the legal challenges, Forbes reports that Musk has maintained his position as a dominant political donor.

Impact on 2026 Political Activity

The settlement arrives as the 2026 midterm election cycle enters its final weeks. Musk remains a central figure in political financing, with records indicating approximately $276 million in contributions toward current campaigns.

While the settlement resolves the primary fraud claims regarding the 2024 giveaways, it remains unclear if the confidential terms include restrictions on future sweepstakes. The outcome concludes a two-year legal saga that forced a judicial distinction between public sweepstakes and the use of “vetted” spokespeople in political messaging. According to The Guardian, the resolution effectively ends the most significant private litigation regarding the transparency of the PAC’s $1 million daily prizes.
