As platforms grapple with how to define and manage such content, stakeholders from lawmakers to tech companies are weighing in, each providing a glimpse into the multifaceted issue.

Defining Adult Content: The Legal Perspective

Alan Butler, executive director of the Electronic Privacy Information Center, suggests that the determination of what constitutes adult content often hinges on legal interpretations. “It’s mostly a counting question in terms of ‘does the law apply?’” he explains. This presents challenges for platforms like X, which faces scrutiny for potentially housing a substantial volume of pornographic material.

Arizona’s recent age verification law introduces a one-third threshold for content classification, a figure sustained by Supreme Court precedents. Kupper, who sponsored the legislation, reports estimates circulating that suggest between 15 to 25 percent of accounts on X may contain pornographic content. However, accurate measurement remains elusive, raising concerns about the feasibility of content analysis across continuously evolving platforms.

Age-restricted adult content on X can only be accessed by users who are logged in and over 18. While X typically relies on users to mark their content explicitly, critics argue for a more rigorous approach: “Do you have pornographic material on your site? Okay. For any of that material, age verification should be mandatory,” Kupper asserts.

Challenges of Implementation and Responsibility

The onus of proving compliance with content guidelines may fall on the individuals and families affected by the material in question. In Arizona, this means a complaint must be filed to trigger legal scrutiny of X’s content, pushing the burden onto victims rather than placing responsibility on the platform itself.

Concerns over similar measures were voiced by Nebraska state senator Dave Murman, who expressed uncertainty as to whether platforms like Grok meet content thresholds that would necessitate age verification. “While I’m in favor of stringent measures, doing so without infringing on valid free-speech rights seems nearly impossible,” he said.

The tension between safeguarding minors and upholding free speech remains a sticking point in the ongoing dialogue around digital content. Pornhub has taken a strong stance by blocking access to its content in states implementing rigorous age verification laws, citing noncompliance issues and users’ reluctance to share sensitive information.

Solomon Friedman of Ethical Partners Capital points out the flaws in existing age verification methodologies, suggesting that a more holistic approach incorporating technology would be beneficial. He proposes that corporations like Google, Microsoft, and Apple implement device-based age verification, which would store users’ age information securely, mitigating the need for third-party verification.

This could extend beyond traditional adult platforms to refine how we handle explicit content across various sites and social media—an aspiration shared by many in the industry. Collaborative efforts among tech giants could pave the way for a more streamlined solution, reducing the potential for harmful exposure.
